Session Information and Understanding: The terms and conditions are written for the sole purpose of booking and reserving a date for a photography session. The signing of the contract states the client's understanding that this is their choice to participate in the photos and the client will not hold Soulistic Shots Photography responsible for any negative actions or feelings that may commence due to the images of this shoot. Any modifications made to this contract must be done in writing and agreed by both parties. No harassment of any kind will be tolerated and will result in the session being terminated immediately without any refund or rescheduling of a new session.

Reschedule Policy: I understand that if a session must be rescheduled; a 48-hour notice is required. All retainer fees are not refundable. Failure to reschedule sessions within the stated timeframe will require additional fees to reserve a new session date. In the event of inclement weather, Soulistic Shots Photography and the client will reschedule to the next available appointment with no charges.

Late fee: I understand that if I arrive late, time will be deducted from the allotted time for the session. If you are less than 15 minutes late, you will not be charged a late fee. Arrival more than 15 minutes late is a $30 late fee. If you are more than 30 minutes late, your session will be canceled and your deposit will not be refunded. If you wish to reschedule, you will be charged an additional booking retainer. I understand that if the session is canceled, all retainer fees are non-refundable. I understand that the continuation of a session after the 15-minute period is at the discretion of the photographer and time will be deducted from the session. Soulistic Shots Photography is a shared space with additional photographers and sessions are generally scheduled back to back and we do not leave room for sessions to start late.

Cancellation: I understand that if I should cancel this agreement before the event date, any monetary investment (retainer and/or final amount) paid shall not be refunded. I understand that it is my responsibility to contact Soulistic Shots Photography if anything changes. If I have a medical emergency or any unforeseen weather crisis occurs (with valid proof), I must notify Soulistic Shots Photography within 24 hours of the session date for the option to reschedule. It is the professional responsibility of the client to send a courtesy text, call, email, or DM if the session time cannot be met; however, the photographer will give one courtesy call, text, or email before canceling the session due to failure to arrive to the session. I understand that if I fail to arrive to the scheduled session the retainer fee will not be refunded and Soulistic Shots Photography has the right to charge the card on file (50% of the final payment).

No Call/No Show Policy: I understand that I am equally responsible to demonstrate professionalism when working with Soulistic Shots Photography. Please provide a courtesy call, text, email, or DM when you are aware that you will not attend your scheduled session. Failure to communicate with the photographer will forfeit booking with Soulistic Shots Photography in the future, the retainer will remain nonrefundable and the card on file will be charged 50% of the remaining balance.

Client Usage Rights/Copyrights: The photographs produced by Soulistic Shots Photography, LLC are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without the explicit written permission of Soulistic Shots Photography, LLC. I understand that it is a breach of this contract to reproduce images (i.e. filters, manipulation, etc.) in any form unless rights were purchased within the package for those images. I agree that Soulistic Shots Photography may use such images with or without my name for any lawful purposes, including but not limited to publicity, illustration, advertising, and web content. The client is obtaining prints for personal use only and shall not sell said prints or authorize any reproductions thereof by parties' other than Soulistic Shots Photography.

Social Media: I understand that I may share blog posts, links and social media posts through use of the share function and direct links. I understand that I shall not copy, download, screenshot, alter the image in any way (Instagram or Facebook filters) or capture the photographs in any other fashion. All pictures taken by Soulistic Shots Photography should show credit towards the photographer by social media tag or credit in the caption.

Group Session Policy: I understand that if I book a group or family session, the session does not begin until all parties have arrived. The session also does not begin until the responsible party (person that booked the session) has arrived. Soulistic Shots will not begin the session under any circumstances. Please refer to the late, reschedule and studio space policies as they are implemented if all parties fail to arrive at the scheduled time.

Limit of Liability: In the unfortunate event that Soulistic Shots is injured, becomes too ill to photograph the session or illness occurs to Soulistic Shots Photography's family members, or natural disaster beyond the parties control, Soulistic Shots Photography will reimburse the session fee and retainer, but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply if photographic materials are damaged in processing, lost through camera, computer malfunction, lost in the mail, or otherwise lost or damaged without fault of Soulistic Shots Photography.

Client Limit of Liability: In the unfortunate event that the client is injured or a client's guest or family member is injured due to actions and conditions of the shared studio space (Canvas Studio), Soulistic Shots Photography shall have no liability with respect to the Agreement. The client and Soulistic Shots Photography will discuss completion of session, if applicable.

Safety Policy: I understand that Soulistic Shots Photography is committed to providing efficient and professional service. I understand that I am professionally responsible for upholding the well-being, protection and security of the photographer while completing the agreed services. During the scheduled session, if guests are unwell, disrespectful or engaging in unsafe activities, it is at the discretion of Soulistic Shots Photography to continue services. Termination of services by the photographer due to safety, terminates this Agreement and the retainer will not be refunded. However, the client is responsible for paying 50% of the final balance and will receive only images taken prior to the termination of services.

Proof Gallery: I understand that Raw/Unedited images should not be posted on any social media platform nor will raw images be given from the session without the watermarked logo. I understand that if I (or my guests) post the unedited images , the completion of the final gallery images will be discontinued and may result in cancellation of future bookings with Soulistic Shots Photography.

Completion Schedule: I understand that the final edited photos will be sent within 10-14 days from the time that I select and send the desired photos to be edited unless an expedited fee has been applied. Soulistic Shots Photography will deliver unedited photo galleries with a watermark within 48 hours of the photo session. I understand that it is my professional responsibility to select and deliver the desired retouched photos to the photographer within two weeks of receiving the watermarked, unedited images. Failure on my behalf to select pictures within two weeks of the photography session will result in Soulistic Shots choosing the final images to complete the package. I understand that if I miss the deadline that any additional images desired after the two week period shall incur additional charges ($15 per image) for each additional image. If images are desired before the two week turnaround time, an expedited fee of up to $150 will be added to the client's final balance to be paid before the photographer begins retouching the images.

Certain print products will take longer depending on the product’s production time. Soulistic Shots Photography will provide updates of turnaround time for print productions if applicable.

Studio Space: I understand that the studio space is not owned by Soulistic Shots, LLC; therefore the requested time or date could be unavailable. I understand if necessary, Soulistic Shots may need to adjust the time or date of my session. I understand that the studio is a shared space; therefore if I am late another photographer's client could be replace my scheduled time.

Final Payment: I understand that the non-refundable retainer is due to hold the session. I understand that the remainder of the collection amount is due on (preferred method) or before the photo session. All payments will be made through one of the following: Square (booking link), Cash, PayPal, Zelle, Cash App or Apple Pay.

Additional Fees: I understand that off-site location and specialty prop fees will be applied with communication and consent from the client prior to the photo session.

Photo Gallery: I understand that no images or products shall be provided before payment is made in full, this clause includes payment for additional images chosen after the session.

I understand that the images presented in my gallery are the only images available. Raw or unedited images will not be available for purchase.

Professionalism: I understand that it is my professional responsibility to communicate all inspirational photos, ideas and pertinent information related to my session to the photographer prior to my session date. Soulistic Shots reserves the right to decline ideas, services or additional guests if the client fails to communicate prior to the session. I agree and understand that the studio session should not be the first time that the photographer and client share ideas as it takes away from the scheduled studio time.
